The SGA sets the ground rules for how Whitecap will continue to receive federal funding to ensure it can meet its responsibilities in a way that is similar to other governments. There are 19 different chapters, each for a different area or function of government and the extent of the WDFN government to pass laws and develop programs and services.ģ. Fiscal Arrangements and Intergovernmental Arrangements The SGA confirms what areas that Whitecap has Jurisdiction and Authority, or where it can make its own laws and how those laws will work alongside federal and provincial laws. Whitecap agrees that certain matters need to be addressed in the Constitution, such as how leaders are elected, how laws are passed and how the government is accountable to WDFN members. The SGA recognizes the Whitecap members have created their own government through the WDFN Constitution. The WDFN Self-government Agreement (SGA) sets out the jurisdiction and authority of Whitecap Dakota First Nation and its relationship with the Government of Canada. Through the Agreement, both WDFN and the Government of Canada recognize the WDFN government and the WDFN Constitution and how they relate to Canada’s Constitution and federal and provincial law-making powers.Īlthough the SGA is a lengthy & complex document, it is divided into four basic parts: 1. Our Land Code was our first major step in sectoral-based self-government and has generated economic opportunity for our members and made WDFN a leading First Nation in Canada. Our community’s decisions to implement a custom Election Code in 1989, approve the Whitecap Dakota First Nation (WDFN) Land Code in 2004, and adopt of our Membership Code in 2012, combined have effectively removed 35 percent of the Indian Act’s control of WDFN affairs. Our community has taken many steps already towards self-governance and leaving the Indian Act. If approved along with Whitecap’s Constitution, our community will start the new exciting journey of being a self-governing First Nation, moving forward with new tools to continue to build economic wealth, create opportunity and secure social well-being. The agreement will recognize WDFN as a self-governing First Nation-the 26 th in Canada and the 1 st in Saskatchewan. We are now at the end of this journey and see members’ approval of the agreement negotiated between Canada’s representatives and Whitecap Chief and Council. Based on a resolution of support at a band membership meeting this lengthy process began. In 2009, Chief and Council proposed to members that Whitecap should take the journey towards self-governance.
